Can SASSA grants be claimed in a divorce?

The South African Social Security Agency (SASSA) is responsible for the payment of South Africa’s social grants.

But can social grant payments become part of a divorce settlement, or claim?

In short: can someone’s partner claim their SASSA funds or payments?

Here’s what you should know about social grant payments, and why they aren’t included when couples split.

CAN SASSA GRANTS BE CLAIMED IN A DIVORCE?

Mostly, the answer is not. Sometimes, the answer can be yes – when monies are part of total assets, regardless of origin.

South African divorce law grants permission for division of assets, depending on whether in (or outside) community of property.

But in either of these cases, a grant payment is meant for the recipient. Payments can’t be claimed for in a divorce.

For example, someone cannot ask to have a grant transferred after their split.

If grant funds have been saved (e.g. become part of someone’s total assets), there might be a possible claim against them. This is more likely in the event where property and assets are divided.
