Ukiliho Kayishema Fulgence, 62, who was arrested for his alleged involvement in the 1994 Rwandan Genocide, made his third appearance in the Cape Town Magistrate’s Court on Friday, 9 June. The State added dozens of charges to his sheet.

FULGENCE FACES OVER 50 GENOCIDE CHARGES

As previously reported, last week, State Advocate Nathan Adriaanse asked the court to postpone the matter because he had been given two lever arch files filled with evidence.

Fulgence’s defence was handed the hefty charge sheet on Tuesday morning. However, on Friday, the defence told the court that their client had been moved from Pollsmoor to Helderstroom Prison in Caldeon, which made it difficult to consult.

The defence asked for the matter to be postponed for a consultation to take place. The State did not oppose the request as it was in the interest of justice for Fulgence to communicate with his defence and give them instructions.

“The State has increased the charges to 54, which comprised nine counts of fraud, ten counts of the Contravention of Section 37(a) of the Refugees Act 130 of 1998, read with Section 1 of the said Act and 35 counts of Contravention of Section 49(1)(a) of the Immigration Act 13 of 2002, read with Section (1) of the said Act,” said National Prosecuting Authority (NPA) spokesperson Eric Ntabazalila.

Fulgence initially faced two counts of fraud and three counts of contravention of the Immigration Act.

POSTPONED FOR CONSULTATION

Adriaanse said the defence is expected to tell the court whether the accused intends to forge ahead with his plan to apply for bail.

The matter was postponed to 20 June for consultation and for the defence to indicate whether they will apply for bail.

As previously reported, Fulgence is accused of playing a central role in the massacre of approximately 2000 Tutsis, including women, men, children and the elderly, at the Nyange Catholic Church during the 1994 Rwandan genocide.

The International Residual Mechanism for Criminal Tribunals (IRMCT) Office of the Prosecutor (OTP) and South African law enforcement arrested him on 24 May through a joint operation.
