ANC Welcomes Brian Molefe Judgement: Pay Back the Money (R11 Million)

The North Gauteng High Court has ruled that the reappointment of the former Eskom Group Chief Executive Officer (GCEO), Brian Molefe, was unlawful and has been set aside.

The court found that Molefe’s claim of early retirement was contrived and therefore invalid. Molefe was also found to not be entitled to a pension pay out from Eskom and has been ordered to pay back the R11 million he received as a pension pay out within 10 days.

The ANC Study Group on Public Enterprises said in a statement that it welcomes the ruling.

“We are vindicated by this ruling as the ANC has always maintained that the decision to reappoint Mr Molefe was reckless and not in the interest of public confidence in our power utility,” said Whip of the ANC Study Group, Zukiswa Rantho.

“Our view has always been that Mr Molefe had resigned from Eskom though he later claimed otherwise. We maintained that Mr Molefe therefore did not qualify for a pension fund pay out from Eskom because he was a contract employee.

“This judgement validates the need for our parliamentary inquiry into the state of governance at Eskom. It is quite evident that there has been an erosion of good governance at our electricity public utility.

“We are committed to rooting out corruption and mismanagement of our state owned enterprises. We will leave no stone unturned in unearthing wrong doing at Eskom and ensure that those found to have been involved are held accountable.”

Molefe was not in court for the ruling.
