The Department of Correctional Services (DCS) says its National Commissioner Samuel Thobakgale will decide on whether or not former President Jacob Zuma will be jailed on or before 10 August.

This comes as the Constitutional Court recently dismissed a bid to overturn the Supreme Court of Appeal (SCA) ‘s ruling that former President Jacob Zuma must return to prison.

In a statement, DCS said it has received representations from relevant parties on Zuma’s incarceration.

“The next phase is for the National Commissioner, Mr Makgothi Samuel Thobakgale to consider every material received, the judgement of the Supreme Court of Appeal and prescripts within the space of corrections.

“Commissioner Thobakgale is to make his decision on or before 10 August 2023 and it will be communicated publicly,” the department said.

Zuma missed the deadline to appeal the SCA ruling but applied for leave to intervene. The Apex Court dismissed this, also with costs, as there would not be an appeal.

Zuma was jailed in July 2021 for refusing to abide by the court’s directive to appear before the Commission of Inquiry into Allegations of State Capture also known as the Zondo Commission and testify.

His initial arrest sparked widespread protests that saw at least 337 people killed.
